Booking & Agreement

A session deposit is required at the time of booking and is non-refundable. Session dates are not secured without a deposit.

By booking a session with Maxine Evans Photography, you acknowledge and agree to all Terms and Policies outlined on this page, regardless of method of payment.

Pricing and package details are guaranteed as quoted at the time of booking and are subject to change for future sessions.

Session Scheduling & Baby’s Arrival

Booking reserves your baby’s place on my calendar; however, the exact session date is scheduled once your baby arrives.

Newborn sessions are best photographed within the first 5–10 days after birth, when babies are typically sleepiest.

Clients are responsible for notifying Maxine Evans Photography within 24 hours of birth. Failure to notify within this timeframe may result in forfeiture of all monies paid.

A newborn information form must also be completed within 4 days of birth to allow proper session preparation.

In-Home Session Guidelines

Sessions take place in your home and are designed to be calm, safe, and baby-led.

Only individuals participating in the session may be present.

Extended family, friends, and caregivers are not permitted.

Maxine does not consent to being recorded. Personal photography or recording (phones, cameras, or video) is not permitted during sessions.

A peaceful, distraction-free environment is essential for newborn safety and session success.

Session Timing

Session length varies depending on the collection selected and your baby’s needs.

Sessions may conclude earlier if the session is naturally completed.

Late arrivals or delays may result in fewer images. No refunds are issued for shortened sessions.

Health & Illness Policy

For the safety of all newborns, sessions will not proceed if illness is present.

If anyone in the household is ill or showing symptoms, you must notify Maxine Evans Photography at least 48 hours in advance.

Failure to notify may result in session cancellation and forfeiture of fees. A rescheduling fee may apply.

Clients must disclose any medical conditions or concerns affecting the baby prior to the session.

Home Readiness for In-Home Sessions

Clients are responsible for ensuring a safe, clean, and temperature-appropriate environment for the session. Maxine Evans Photography reserves the right to modify session flow or poses based on available light, space, and environmental conditions within the home.

To ensure newborn comfort and safety, homes should be comfortably warmed for the session. Air conditioning adjustments may be requested during posing. Session flow may be adjusted as needed for your baby’s comfort. The ideal temperature is 80-85.

Working With Newborns

Newborn photography is unpredictable and results vary.

The number of poses and final images may vary.

Baby comfort and safety are always the top priority.

Fussy, hungry, colicky, jaundiced, or alert babies may result in fewer images.

If a session takes place, no refunds are issued, even if the final gallery contains fewer images due to baby-related factors.

Family & Sibling Participation

Newborn sessions are not family sessions unless specifically booked as such.

Sibling or parent images must be discussed prior to booking and may involve additional fees.

For safety reasons, toddler and newborn posing is not guaranteed and may be declined at the photographer’s discretion.

Pets

Requires pets to be secured and not in the space we are using.

Creative License

Maxine Evans Photography retains full creative control over session styling, props, color palettes, image selection, and editing.

All images are hand-edited by Maxine Evans personally. Editing is part of the artistic process and cannot be undone.

Additional retouching beyond standard edits begins at $45 per image.

Raw, unedited images are not available for viewing or purchase.

Copyright & Image Use

Maxine Evans Photography retains full copyright to all images.

Images may not be copied, downloaded, screenshot, altered, or used for commercial, promotional, or vendor purposes without written permission.

Clients receive a personal print release for personal use only.

Online Galleries & File Delivery

Galleries are delivered within 10 days of the session.

Galleries remain active for 10 days for viewing and selection.

A gallery reload fee of $50 applies after expiration.

Download links are active for 5 days.

Digital files are stored for up to one year (not guaranteed).

Clients are responsible for backing up their images. Maxine Evans Photography is not responsible for file loss, compression, or improper downloads.

Products & Sales

All sales are final.

This includes digital images, prints, albums, announcements, USBs, and wall art.

Products created through third-party labs are not guaranteed for color accuracy or quality.

Payment Terms

A session deposit is required at booking and applied toward your final balance.

The remaining balance is due no later than 24 hours PRIOR to your scheduled session.

Failure to submit payment by this time will result in session cancellation and forfeiture of the deposit.

Deposits and session fees are non-refundable.

Pricing is non-negotiable. Re-shoots are not offered.

Rescheduling & Cancellations

A minimum of 72 hours’ notice is required to reschedule.

Same-day cancellations and no-shows result in forfeiture of all monies paid.

If a session is canceled by Maxine Evans Photography, a replacement session will be offered when possible.

Weather & Environmental Conditions

Sessions may be rescheduled due to severe weather conditions, including hurricanes, tropical storms, flooding, extreme heat, or power outages that may impact safety or session quality. In such cases, Maxine Evans Photography will work with the client to reschedule at the earliest mutually available date. No refunds will be issued due to weather-related rescheduling.

Liability Waiver

Clients release Maxine Evans Photography from all claims, damages, or liabilities arising during the session, including damage to personal property.

Participation in a session constitutes acceptance of this waiver.

Third-Party Bookings & Conduct

Only a baby’s legal parent(s) may book and consent to sessions.

Third-party bookings are not accepted and will result in cancellation without refund.

Maxine Evans Photography reserves the right to refuse service.

Privacy & Confidentiality

Client privacy is of the utmost importance.

Any non-disclosure requests must be made in advance.

High-profile and private clients are treated with the highest level of discretion.
